Terms & Conditions

1. Information on how to enter and prizes form part of these conditions of entry. Entry into the
promotion is deemed acceptance of these terms and conditions. Any images uploaded that are
not in accordance with these terms and conditions may be removed without notice.

2. The promotion is open to New Zealand residents. Employees of the Promoter and any agency
involved with this promotion, and the immediate families of such employees, are not eligible to
participate in this promotion.

3. The promotion commences on Friday 3rd March 2016 at 10am and finishes on Saturday 3rd June
2016 at 10am (‘Promotion Period’).

4. To enter, entrants must login to the Pitch Side Experience Facebook App via Facebook
(‘Application’) and upload an image and supply their full name, email address, phone number,
and confirmation that they are over the age of 18 or have parental consent to enter, and select
from the available games which one they would like to enter to win (one game per entry). To be
valid:
a. the image must be of the entrant attempting to show how much of a Super Rugby Fan
they are; and
b. the image must be an original image created for this promotion.

5. One winner will be selected by the Promoter at 2pm on each of the dates: 13 March 2017 (Crusaders),
21 March 2017 (Blues), 26 April 2017 (Chiefs), and 20 May 2017 (Highlanders), 5 June 2017 (Hurricanes)
at Ogilvy & Mather, 22 Stanley St, Parnell, 1010, Auckland. The selection will be based on merit, and will be
determined by the Promoter in its sole discretion. Winners will be notified by email and/or phone by the Promoter.

6. Entrants must own the copyright in the image uploaded and be able to assign this copyright under
clause six of these terms. Each image must be an original work.

7. All promotion entries (including but not limited to the images that are uploaded as part of each
entry) become the property and copyright of the Promoter. By entering this promotion, entrants
assign copyright in their entry to the Promoter. Participants agree not to assert any moral rights in
relation to such use and warrant that no other person will do so and that they have the full
authority to grant these rights.

8. Participants acknowledge that all images uploaded via the Application will be moderated per
clause 9 and will be displayed in the gallery feature on the Application.

9. Participants agree that they are fully responsible for the image they submit. The Promoter shall not
be liable in any way for the image to the full extent permitted by law. The Promoter may remove
any image without notice for any reason whatsoever. Participants warrant and agree that: (a) they
will not submit any image that is unlawful or fraudulent, or that the Promoter may consider in
breach of any intellectual property, privacy, publicity or other rights, or defamatory, obscene,
derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening,
objectionable with respect to race, religion, origin or gender, not suitable for children aged under
18, or otherwise unsuitable for publication (including but not limited to any inclusion of or
reference to nudity, swearing, alcohol, smoking, or drugs); (b) they will obtain full prior consent
from each person that appears in their image (and if any person is under 16 years of age from a
parent of the person); (c) they will obtain full prior consent from any person who has created,
jointly created or has any rights in the image, to the uses and terms herein; (d) their image must
not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all
applicable laws and regulations, including without limitation, those governing copyright, content,
defamation, privacy, publicity and the access or use of others' computer or communication
systems

10. Entrants may enter the promotion multiple times, provided that each image submitted has not
previously been submitted to this promotion.

11. The Promoter may award additional prizes in connection with this promotion on the KFC New
Zealand Facebook page in its sole discretion.

12. Winners will need to confirm their attendance within 48 hours from the date of notification. In the
event that an ineligible entry is selected or the Promoter is unable to contact a finalist within 48
hours of their selection, having made reasonable attempts to do so, the Promoter will deem that
finalist’s entry invalid and may select a new finalist on the same terms as the original finalist
selection. If a new winner is drawn, the above clause apply.

13. Winners will need to provide full list of guest attending within 72 hours from the date of
notification. In the event that the winner is unable to fill all 15 seats, the Promoter reserves the
right to fill remaining seats.

14. All winners are eligible to a unique Pitch Side Experience for them and 14 guests for the following
Super Rugby games –
17 March 2017 Crusaders Experience at AMI Stadium located at 95 Jack Hinton Dr,
Addington, Christchurch
25 March 2017 Blues Experience at QBE Stadium located at Stadium Dr, Albany, Auckland
6 May 2017 Chiefs Experience at Yarrow Stadium located at Maratahu St, New Plymouth
27 May 2017 Highlanders Experience at Forsyth Barr Stadium located at 130 Anzac Ave,
Dunedin
9 June 2017 Hurricanes Experience at Westpac Stadium located at 105 Waterloo Quay,
Pipitea, Wellington

15. The Pitch Side Experience includes:
a. Maximum of 15 seats within the pitch side container at one of the above Super Rugby
games; and
b. KFC catering during the Super Rugby game. KFC will endeavour to satisfy dietary needs
within existing menu options.

16. Prize does not include any travel costs and the winner and their guests will need to make their
own way to and from the location of the event. All guests must be 18 or older at the time of the
Super Rugby game or have parental consent to attend and be accompanied by a nominated adult
over the age of 18. If the prize winner is under 18, the prize will be issued to a parent or legal
guardian of the prize winner as nominated by the prize winner. The promoter reserves the right to
request a minimum of 4 parents or legal guardians over the age 25 years old to form part of the
group.

17. All entries become the property and copyright of the Promoter. By entering this promotion,
entrants assign copyright in their entry to the Promoter. Images may be used by the Promoter on
the Promoter’s social media accounts including but not limited to Facebook, YouTube,
Instagram, Twitter, the KFC website or any of its subsidiary domains, and in other media or
promotional material by the Promoter’ s sole discretion. The Promoter may edit any image
submitted as part of a promotion entry as they see fit.

18. By entering this Promotion, entrants agree to the use of their names, images and likeness for
promotional/advertising purposes, and agree to make themselves reasonably available for this
purpose. The ensuing copyright will rest with the Promoter, without any claim to compensation
from the entrants.

19. In the event that the prize or any part of the prize becomes unavailable for any reason beyond the
Promoter's control, the Promoter may in its sole discretion decide to provide an alternative prize.

20. The promoter is not liable for any weather event and/or weather delay.

21. Neither the Promoter nor any other entity associated with this competition will be responsible for
any late, lost, misdirected, incorrectly submitted or incomplete entries, including but not limited to
entries not received due to technical problems or human error. In particular, and without
limitation, the Promoter is not responsible for any problems or technical malfunction of any
telephone network or lines, servers or providers, or any combination thereof and is not responsible
for any incorrect or inaccurate information caused by any of the equipment or programming
associated with or utilised in this competition, or by any technical error that may occur in the
course of the administration of this competition. The time entries and votes are deemed to be
made will be the time the entry or vote is received, not the time the entry or vote is submitted.

22. The Promoter reserves the right to disallow entries in its absolute discretion and without giving
reasons.

23. The Promoter reserves the right, at any time, to verify the validity of claims and determine the
eligibility of entrants (including an entrant's identity) and to disqualify any entry or refuse to award
a prize where false or misleading details have been given by an entrant, where the voting has been
tampered with, or where an entrant has behaved in a fraudulent or dishonest manner, or otherwise
than in accordance with these terms and conditions or the spirit of the promotion.

24. If a winner cannot accept or take part in the prize for any reason, their prize will be void and no
compensation will be made available nor exchangeable.

25. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of
those rights.

26. All decisions made by the Promoter its employees or agents are final and no correspondence will
be entered into.

27. If the promotion is not able to operate as anticipated for any reason, the Promoter may amend,
suspend or cancel any aspect of the competition (including any prize) at any time in its sole
discretion.

28. Except for any liability that cannot be excluded by law, the Promoter (including its officers,
directors, shareholders, employees, advisors, assignees, agents, licensees, representatives,
advertising and promotional agencies), excludes all liability (including negligence), for any
personal injury or any loss or damage (including loss of opportunity), whether direct, indirect,
special or consequential, arising in any way out of the Promotion, including, but not limited to,
where attributable to any of the following: (a) any technical difficulties or equipment malfunction
(whether or not under the Promoter's control); (b) any theft, unauthorized access or third party
interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected ; (d) any
variation in the prize; (e) any tax liability incurred by a claimant or entrant; or (f) use of a prize.

29. To the fullest extent permitted by law, the Promoter is not liable for any loss, damage, or injury by
or to any person in connection with this promotion or with winning or benefiting from a prize.

30. The winners are bound by the conditions of entry and behaviour at Eden
Park/AMI/Westpac/FMG/Forysth Barr Stadiums (as applicable). Winners are responsible for their
own behaviour and the promoter will not be liable for any damages or eviction from any venue or
transportation related to unacceptable behaviour including but not limited to intoxication as
deemed by the venue management, transport provider or promoter and their appointed
promotional representative.

31. As a condition of participating in the promotion, participants indemnify the Promoter, all
organisers, sponsors and all other persons and organisations associated in any way with this
promotion against all claims, damages, liabilities, costs and expenses (including costs on a
solicitor-client basis) which the participant may incur arising out of their participation in the
promotion and/or participating in the prize, howsoever caused.

32. Entrants acknowledge that any images submitted as part of this promotion will be publicly
available on the Site, and may be shared on social media by any person. The Promoter is not
responsible for the use or dissemination by third parties of any entries submitted as part of this
promotion.

33. The Promoter and its agent Ogilvy & Mather New Zealand, collects and holds personal
information provided by entrants and voters for the purposes of this promotion and for future
promotional purposes. Failure to provide requested personal information may disqualify a person
from being able to receive a prize. All personal information provided by entrants will be held by
the Promoter. Under the Privacy Act 1993, entrants have the right to access and correct any such
personal information. Entrants may access and request correction of any of the details about them
held by the Promoter by using the contact form located at www.kfc.co.nz/contact-us/.

34. This promotion is in no way sponsored, endorsed or administered by or associated with, Facebook.
Any information provided by entrants on the KFC Facebook Page is provided to the Promoter and
not to Facebook.
